Description
The Theft Act governs the picking of plant and fungi material on private land not owned by the picker. The legality of the action is conditioned by the intent of the picker. Non-commercial picking is not a crime, whereas picking for commercial sale requires the consent of the landowner or it becomes a criminal activity.
Sections of the Act relevant to NWFP:
”4 Property. (3) A person who picks mushrooms growing wild on any land, or who picks flowers, fruit or foliage from a plant growing wild on any land, does not (although not in possession of the land) steal what he picks, unless he does it for reward or for sale or other commercial purpose.
